Defense motions that could have a domino effect on Delaware litigation over the pre-IPO Truth Social merger will be addressed in the next few weeks, Vice Chancellor Morgan Zurn decided at a recent hearing in which attorneys sparred over whether the court should first address a preliminary injunction or a motion to dismiss.

During the April 23 hearing, Berger McDermott partner Richard Jones, appearing for the plaintiff, asked that any motions to dismiss be briefed alongside those involving the preliminary injunction. But defense attorneys at the hearing said they’re in favor of addressing the motion to dismiss before the preliminary injunction, which they said was unwarranted.
