A federal judge in Maryland has certified a question to the state high court asking whether the Maryland Child Victims Act of 2023 violates a nonperpetrator defendant’s due process rights in a case brought by a former student who claims she was abused in the 1970s.

Plaintiff Valerie Bunker filed suit against Annapolis, Maryland-based The Key School and The Key School Building Finance Corp., claiming the institution failed to protect her from sexual and emotional abuse committed by her teachers while Bunker was a high school student. Bunker brought allegations of negligence, negligent hiring and negligent supervision and retention of employees, claiming the school was aware of the abuse, according to her complaint filed in U.S. District Court for the District of Maryland.
