Attorneys for Jeffrey Epstein associate Ghislaine Maxwell on Tuesday urged a three-judge panel of the U.S. Court of Appeals for the Second Circuit to vacate her conviction, arguing that Manhattan federal prosecutors failed to abide by Epstein’s 2007 non-prosecution agreement.

Diana Fabi Samson of Aidala Bertuna & Kamins argued that Maxwell qualifies as a third-party beneficiary to Epstein’s non-prosecution agreement in the Southern District of Florida and therefore should not have been prosecuted, even outside Florida.
