The Missouri Court of Appeals reinstated a jury’s verdict assessing 15% fault to a woman suing for injuries sustained from a car crash, finding the lower court abused its discretion in granting her a new trial after she had declined to seek a mistrial for opposing counsel’s conduct during closing arguments.

Presiding Judge Lisa P. Page, on behalf of Division Two of the Missouri Court of Appeals, determined that St. Louis Circuit Judge Michael W. Noble erred in granting Anastasia Collier’s motion for a new trial because the court lacked good cause to do so, as Collier hadn’t suffered any prejudice from the alleged error, according to the appellate court’s May 30 opinion.
