The U.S. Chamber of Commerce, the American Tort Reform Association and three other business groups urged an appeals court to rehear its groundbreaking decision upending Johnson & Johnson’s talcum powder bankruptcy case.
Johnson & Johnson subsidiary LTL Management, which filed for Chapter 11 protection in 2021, petitioned the U.S. Court of Appeals for the Third Circuit last month to rehear its Jan. 30 decision, which reversed a bankruptcy judge’s ruling, paving the way for talc trials to resume in courts across the country. The Commerce Chamber, the ATRA, the National Association of Manufacturers, the Product Liability Advisory Council Inc. and the Washington Legal Foundation all filed amicus briefs supporting rehearing, which was opposed by claimants alleging Johnson & Johnson’s talc products caused them to get ovarian cancer and mesothelioma.
