The U.S. Court of Appeals for the Tenth Circuit rejected arguments made by the State Bank of Southern Utah that the untimely filing of a complaint—just 16 minutes late—was caused by a technical failure of the bankruptcy court’s Electronic Case Files system.
According to the opinion, a Utah state court entered a judgment in December 2018 in favor of the bank against Allen Beal for $237,683.01 for loans collateralized by cattle and other property. Beal filed for bankruptcy on Jan. 15, 2019, under Chapter 7 in U.S. Bankruptcy Court for the District of Utah. The bank wanted to prevent Beal discharging that debt.
