A Provincetown, Massachusetts, waiter was granted a motion for default judgment as a sanction after his former employer failed to participate in the discovery process “in good faith and in compliance with court orders.”

According to the opinion, the Massachusetts district court granted the motion to plaintiff Travis Costa, in an action he brought against his former employer, Saki, and manager Steven Schnitzer for alleged retaliation against him after he complained that he was underpaid for the number of hours worked in violation of the Fair Labor Standards Act, the Massachusetts Wage Act, and the Massachusetts Overtime Law.
