A federal judge “clearly abused his discretion” in failing to rule on hundreds of motions to remand opioid cases back to state courts, according to a federal appeals court mandate on Friday.
The U.S. Court of Appeals for the Sixth Circuit ordered that U.S. District Judge Dan Polster, who is overseeing 3,000 opioid lawsuits in multidistrict litigation, address hundreds of remand motions pending before him for more than three years in cases brought by cities and counties.
