The Ohio Supreme Court unanimously reversed lower courts’ decisions to dismiss a grandmother’s lawsuit against caseworkers for her 2-year-old granddaughter’s death, but it offered differing opinions as to why she should be permitted to go forward with the case.

Desena Bradley filed the lawsuit in Hamilton County Common Pleas Court in March 2017 after her 2-year-old granddaughter was killed by her parents, despite caseworkers’ alleged knowledge of ongoing abuse. Bradley claims the caseworkers involved in her granddaughter’s case failed to properly investigate or follow up on what “should have been clear signs of abuse,” just weeks prior to the girl’s death.
