Baker McKenzie filed a lawsuit Wednesday on behalf of the parents of several school-age children with disabilities whose requests for in-person education during the 2020-2021 school year were denied. The complaint, against the superintendent of Fairfax County Public Schools, alleges that the district effected a “constitutional taking” of the students’ protected property interests in their education amid the COVID-19 pandemic. Counsel have not yet appeared for the defendant. The case is 1:21-cv-00987, Chollet et al v. Brabrand.
