An expanded panel of the Pennsylvania Superior Court has agreed to review a recent decision that said the federal statute limiting civil liability for the gun industry is unenforceable and “repugnant to the Constitution of the United States.”

On Thursday, the Superior Court granted en banc review of the case Gustafson v. Springfield, which, in September, led a three-judge Superior Court panel to determine that the federal Protection of Lawful Commerce in Arms Act was unconstitutional. The ruling allowed the family of a teen killed in an accidental shooting to sue companies involved in the manufacture and sale of the gun.
