SAN DIEGO — The man accused of threatening to shoot up Shoal Creek Elementary School in Carmel Mountain Ranch last December appeared in court Friday morning.
The preliminary hearing for Lee Lor, 38, was supposed to go forward. However, his new public defender was not able to appear in court on his behalf. Therefore, the defense requested his hearing be postponed.
"The people are opposed to this continuance," said Deputy District Attorney Savanah Howe.
"We were not aware until this morning that there would be a continuance and a new public defender would be assigned. I have several witnesses in the hallway ready to go," she added.
However, the judge agreed to postpone the hearing until May 29.
He also ordered the media to blur Lor's face. The 5'3", 150-pound defendant faces two counts of making criminal threats.
According to court papers, Lor told investigators he wanted to shoot up Shoal Creek because it is "where the neighbor kids attend school."
The home address Lor gave authorities is located about a mile from Shoal Creek. He is a former security guard and ex-military.
On Friday the judge ruled protective orders must remain in place for three people, possibly the family Lor was allegedly targeting. The judge reminded Lor he must have no contact with them. Lor will remain behind bars without bail until his next court appearance.
A family seated outside the courtroom, who were ready to testify as witnesses, declined to talk to CBS 8, but said they appreciated the media continuing to follow this story.
If convicted Lor faces a maximum of six years behind bars.
"We will continue to do what we can to ensure the community is kept safe," said Howe.
