Judge Rules NY Must Reopen Rent-Relief Portal Within 3 Business Days


New York will need to Reopen its Rent-Relief Portal within Three Business days, a State Judge ruled today.

The Emergency Rental Assistance Program (ERAP), is an Economic Relief program, developed to help Eligible households residing in their Primary Residence, in New York State, request Assistance for Rental and Utility Arrears, accumulated during the COVID-19 crisis.

The State had largely Stopped accepting Applications for ERAP's $2.4 billion in November 2021, saying that it had exhausted All of the available Funds.

A Group of Tenants then Sued, the Office of Temporary and Disability Assistance, which is running the Program, in December 2021, asking the Court to Reopen the Portal, and arguing that its decision to Close it was Premature and Abrupt.

Judge Lynn Kotler, has sided with the Tenants, writing in her Jan. 6, 2022, Decision that the State must Resume accepting Applications “as soon as is practicable but no later than three business days after entry of this decision/order.”
