Evansville woman enters plea agreement, is sentenced for 2019 death of Delvin Mitchell

EVANSVILLE, Ind. — An Evansville woman charged in the 2019 death of Delvin Mitchell, 25, accepted a plea agreement in connection with the case and was sentenced Thursday. 

Circuit Court Magistrate Judge Celia Pauli sentenced Amber Brewer, 29, to 578 days – approximately one and a half years – in prison with credit for time served as part of a plea agreement.

Per the agreement, Brewer pleaded guilty to assisting a criminal who committed murder. The judge dismissed a murder charge and an enhancement for using a firearm in commission of an offense.

The court credited Brewer for the time she served in the Vanderburgh County Jail between March 19, 2020, and May 26, 2021. With credits, the court determined that she has served the sentence, according to the sentencing order.

Brewer fled the Evansville area with her husband, Justin Brewer, 33, after law enforcement found Mitchell dead of an apparent gunshot wound to the head in a vehicle on Frisse Avenue on Jan. 25, 2019. 

According to an Evansville Police arrest affidavit, Brewer took her husband to meet with Mitchell for an alleged drug deal that night.

Investigators believe Justin Brewer was the one who shot Mitchell with a gun that was later recovered from Pigeon Creek near Diamond Avenue. 

In May, a jury found Justin Brewer guilty of murder. His sentencing hearing is scheduled for Friday.

The Brewers were extradited to Evansville from Atlanta, where they were arrested, and taken into federal custody on federal weapons charges. 

Last year, Amber Brewer pleaded guilty to a federal charge for providing a firearm to a prohibited person. Her sentence was for time served, but she has remained in the Vanderburgh County Jail awaiting the outcome of this local case.

Justin Brewer pleaded guilty to two federal charges of felon in possession of a firearm and was sentenced to 37 months in prison.
