Growth Energy to sue EPA for missing 2021 RVO deadline

Growth Energy has filed a letter of intent to sue the EPA for failure to issue 2021 Renewable Volume Obligations by the November 30th deadline.

The notice gives EPA 60 days to issue the 2021 RVO before risking a lawsuit in federal court.

Growth Energy cites that issuing the RVO by the deadline outlined in the Clean Air Act and Renewable Fuel Standard is a statutory obligation of the EPA to provide biofuel and fossil fuel companies with their total renewable fuel blending obligations for the following year.

Growth Energy CEO Emily Skor says the agency’s inaction undermines the RFS and “piles on the uncertainty” in the fuels marketplace as it tries to recover from COVID-19 disruptions.
