Why legal experts think Giuliani and Trump's election lawsuits are 'beyond embarrassing'
President Donald Trump tapped his personal attorney Rudy Giuliani to lead what Trump campaign adviser Jenna Ellis has described as an "elite strike force" of lawyers commandeering the president's post-election legal challenges. But legal experts aren't impressed.
A new editorial published by NBC News highlights the concerns of legal experts who are highly displeased with both Trump and Giuliani's misuse of the courts in a futile effort to overturn the outcome of the presidential election. Legal experts have lambasted the leading attorney for enabling the president while perpetuating his baseless claims of widespread voter fraud.
"It's beyond an embarrassment," said lawyer Glenn Kirschner. "It's both really poor lawyering and it has the worst possible motive behind it. It's all in the name of overturning the will of American voter."
The editorial also highlights monumental errors that have been noted in the Trump campaign filings. From confusing the locations of several counties in Minnesota in one lawsuit to spelling ballots as "ballets" in another, and including an incorrect reference to Trump as "Presidential Donald J. Trump" in another, a substantial number of legal experts have noted just how poorly the lawsuits are perceived in the legal world.
Election lawyer Matthew Sanderson offered an unfavorable comparison of Giuliani to James Baker who spearheaded the legal challenge in the Bush v. Gore election case.
"This is like Bush v. Gore, but replace James Baker with the editor of a QAnon subreddit," Sanderson said. "It's not competent lawyering. There are strategic errors, typographical errors — every kind of error you can make in a case."
Describing their legal strategies as "dysfunctional," Sanderson admitted that the lack of evidence, along with Giuliani and Trump's handling of the ordeal suggests there is nothing that can be done to save the Trump campaign's case.
"It's as dysfunctional a litigation strategy as I've ever seen," Sanderson added. "I don't think any team of lawyers can save this case. Election litigation is not designed to overturn tens of thousands of votes. That just doesn't happen. But even with that caveat, this strategy has not been well-executed."
