Las Cruces City Council to discuss UTV definition

LAS CRUCES - The Las Cruces City Council will meet Monday to consider the adoption of an ordinance that corrects the definition of a utility terrain vehicle.

Earlier this year, the council authorized Utility Terrain or Utility Task Vehicles on city streets, with certain exceptions. As currently written, the ordinance defines a UTV as a vehicle with a speed capability of no greater than 45 mph. However, most UTVs can go faster 45 mph.

The proposed ordinance would change the definition of UTV to eliminate the speed capability and amend it so that "engine displacement less than 1,000 cubic centimeters" becomes “equal to or less than 1,000 cubic centimeters.”

Though UTVs can go faster than 45 mph, they are prohibited from doing so on city roads.

Also Monday, the council will consider a resolution reimbursing Sierra Norte Development, Inc. for construction of a neighborhood park in the Metro Central, Phase 1 subdivision in an amount not to exceed $592,213.07.

The park would be comprised of two tracts at 1.40 acres and 1.255 acres for a total of 2.655 acres. The completed park will contain bike racks, a drinking fountain, benches, picnic shelters, landscaping, exercise structures, and other amenities.

The city council meeting will be televised live at 1 p.m. Monday on CLC-TV, Comcast Cable channel 20. The meeting will also be available online at clctv.com and at YouTube.com/clctv20.
