Court rules WOTUS rule unlawful

The 2015 Waters of the United States (WOTUS) rule has been deemed unlawful by a federal court.

The Southern District Court in Georgia found the EPA overstepped the Clean Water Act and the Administrative Procedures Act.

The court has kept the preliminary injunction in place preventing the WOTUS rule from becoming effective in the 11 states involved in the lawsuit as the EPA is finalizing its own repeal and replacement of the rule.

American Farm Bureau’s General Counsel Ellen Steen says the court has affirmed what AFBF has been saying for five years – that the rule was federal overreach of the Clean Water Act, disregarding the jurisdiction of waters that must be left to states and municipalities.
