CA Legislature Passes Presidential Tax Returns Bill

On July 11th, the California Legislature Passed SB 27, the Bill to require Presidential Primary Candidates to Reveal the Last Five years of their Income Tax Returns if they want to be on the Presidential Primary Ballot.

It now goes to Governor Gavin Newsom (D) for his Signature.

No Republican voted for it in any Legislative Vote in either Chamber, and No Democrat ever Voted Against it.

But Joe Mathews, Connecting California Columnist and Editor, Zócalo Public Square, Fellow at the Center for Social Cohesion at Arizona State University, and Co-Author of California Crackup: How Reform Broke the Golden State and How We Can Fix It (UC Press, 2010), says Unfortunately, a well-intentioned—if plainly unconstitutional. In Article II, sec. 5, of the California Constitution says: “the candidates on the (presidential primary) ballot are those found by the Sec. of State to be recognized candidates throughout the nation or throughout California.”

President Trump is obviously a Recognized Candidate.

The Bill does Not Bar anyone from Filing as a Write-In, in a Presidential Primary.

Therefore, Trump could become a Write-In Candidate.
