Man accused of sending girl, 13, nude photos blames phone 'glitch', Waynesboro police say

A Maryland man accused of sending a 13-year-old girl nude photos and showing her parts of his body during a video call blamed a phone "glitch" for some of the communication, police said. 

Cody Ryan Fairall, 24, Smithsburg, Md., was charged with three felony counts of obscene and other sexual materials and performances, one felony count of unlawful contact with a minor and one misdemeanor count of corruption of minors, according to court documents

Waynesboro Police were notified about the alleged inappropriate contact between the two in October when the girl's mother came to the station to report she had found a picture of male genitals on her daughter's phone. 

The woman found the photo while monitoring the girl's phone activity, which she said showed the two had been communicating and sending photos back and forth.

The mother said she knew Fairall and said he lived on Mount Airy Avenue in the borough.  She showed police text messages in which she confronted him about sending photos to her daughter, and he responded that he had "just sent her daughter a picture of his abdominals and that was it," documents state. She said she sent him the photo of the male genitals, and he replied that he would call her.

Police later spoke with the teen girl, who said she received an image from Fairall via Snapchat in October that showed him standing in front of a bathroom mirror with his genitals exposed, documents said. She said she had deleted the image.

Officers viewed conversations between the two on several of the teen's social media accounts and noticed messages and photos had been deleted. 

Following two unsuccessful attempts to interview Fairall, authorities were finally able to speak to him in December by showing up at his probation appointment in Adams County. 

As Fairall searched through his phone for the purported image of his abs, he claimed it may have been sent to the girl due to a glitch on his phone. As he scrolled, police saw a photo of him standing naked in front of a bathroom mirror. The officer asked if he could have mistakenly sent the image to the girl, and he again claimed the glitch could have caused it to be sent. 

During the interview, Fairall admitted to communicating with the girl through text messaging, video calling and social media forums under the same usernames the girl previously provided. When asked if he would let officers view these accounts, he told them he deleted the apps off his phone, because he "was tired of the drama," documents stated. He also said he only participated in one video call with the teen, which occurred when her mother and sister were in the room.

While speaking with police again a few days later, Fairall said he started talking to the girl in September and acknowledged sending around five photos through social media, but did not describe them as being inappropriate.

The girl later claimed in another conversation with officers that Fairall sent her about six pictures of him exposed, not just the ones previously mentioned, through social media. Police said she also described one image she received of him naked on his couch, and said he would let her watch him touch himself in the shower through video calling. 

Police requested a search warrant for Fairall's Instagram and Snapchat accounts. They found two saved images of a man exposing himself on a ripped-up couch and a "daddy/daughter themed" tattoo on a man's forearm. Police later spoke to a relative of Fairall's, who said she lives at the Mount Airy Avenue home where the mother said he lived, owns a couch that matches the description of the one in the photo, and that Fairall has a tattoo like the one pictured. 

Police also discovered that around the same time these photos were timestamped, Fairall was talking to the girl on another social media platform about how he was walking around naked, according to documents. They also found transcripts between the two indicating they had video called each other multiple times in September and October, contradicting Fairall's claim he only called her once. The transcripts showed multiple statements of a sexual nature, documents said. 

 

The transcripts also show Fairall telling the girl his phone is glitching because of water he got on his phone following a video call between them on Oct. 18.

A police report stated Fairall was arrested on Monday, March 11, but court documents did not say if he had been arraigned as of Friday afternoon.
