Iowa appeals ‘ag gag’ ruling

The state of Iowa is challenging a federal judge’s ruling that declared the state’s so-called ag-gag law unconstitutional.

The law made it illegal for animal rights activists to film undercover videos at livestock facilities.  It was overturned last month, with the judge citing First Amendment violations.

In his legal motion to appeal, Iowa Attorney General Tom Miller argues there is no First Amendment right to use false pretenses to gain access or employment at an ag facility “with the intent to knowingly commit an unauthorized act”.

The state has also asked the district court to stay the enforcement of the judge’s order, pending the appeal. In its motion for the stay, Miller said the state believes it is likely to succeed on the merits of the case.
