Suit Demands Kemp Not Oversee GA Results


Brian Kemp, Georgia’s Secretary of State and the presumed Republican Victor in a bitterly contested Gubernatorial Race, was hit with an Eleventh-hour Suit in Federal Court Tuesday, seeking to Bar him from Certifying a Winner or Overseeing a possible Recount given the “Extreme Bias” he’s shown as Georgia’s Top Elections Official.

A Group of Five Georgia Voters filed an Emergency Lawsuit against Georgia Secretary of State Brian Kemp on Tuesday that would Prevent him from Presiding over the Georgia Gubernatorial Race, in which he is the Republican Nominee running against Democrat Stacey Abrams.

That Kemp is in charge of Counting Votes in his Own Race has been a point of Contention during the Campaign, which has also been Marred by Instances of Racism against Abrams. The First Black Woman to Clinch a Major Party’s Nomination for Governor, Abrams condemned Kemp for what she called an Abuse of Power after his State Office Launched an Investigation into Georgia Democrats for Involvement in what it said was “Cybercrime.”

It’s that Inquiry that the Voters are Seizing on in an Attempt to bar Kemp from being Involved in Counting Votes, Certifying Results, or Participating in any Runoff or Recount Procedures. The Nonprofit Protect Democracy filed the Suit on behalf of the Voters just Two Hours ahead of Polls Closing in Georgia, alleging that Kemp is Running with an Unfair Advantage.

“That no person should be a judge in their own case is about as basic a rule of fairness as you can get,” said Larry Schwartztol, Counsel for Protect Democracy and a former Attorney for the American Civil Liberties Union. “That principle, embodied in the Constitution’s Due Process Clause, applies with special force to Secretary Kemp, who has misused his official position to try to tilt the playing field of the election in his favor.”

Candice Broce, Press Secretary for the Secretary of State’s Office, said in a Statement early Wednesday: “We have notified Secretary Kemp of this lawsuit. This twelfth-hour stunt will not distract us from fulfilling our responsibilities and working with county officials to ensure a secure, accessible and fair election for all eligible Georgians.“

Hours-Long Lines plagued the Midterm Elections in Georgia, with several Key Counties extending Voting Hours at some Polling Locations. The Abrams-Kemp Faceoff is one of the most Prominent Races of the Cycle, with Out-of-State Cash streaming into both Campaigns. Celebrities also Visited the Peach State to get out the Vote, including Media Mogul Oprah Winfrey, who Canvassed for Abrams.

Winfrey and Abrams were also the Targets in Racist Robocalls aimed at Influencing Voters across the State last week. Those included someone calling Abrams the “poor man’s Aunt Jemima.” Kemp has sought to Distance his Campaign from the Calls, which were Created by a White Supremacist Podcasting website that also Orchestrated similar Calls in Florida.
