<p class="wp-block-paragraph">&#8220;A kindergarten graduation turned violent today&#8221; were the first words of <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.13abc.com/2026/05/22/parents-brawl-over-seating-toledo-kindergarten-graduation-ceremony/">this report from WTVG</a> about a May 21 incident at Queen of Apostles School in Toledo, Ohio. At least a dozen people, all chronologically adult, ended up in a brawl after being unable to resolve a dispute over seating for the ceremony. One woman was arrested and charged with &#8220;felonious assault&#8221; for allegedly grabbing another woman by the hair and banging her head into a chair. The loser of that exchange needed stitches, according to the report.</p>
<p class="wp-block-paragraph">Thankfully, no children were harmed, and no serious injuries were reported and certainly no deaths. As we&#8217;ve discussed before, the name of this category is to be understood sarcastically, not literally. <p class="wp-block-paragraph">Okay, that last one did involve a murder, but that was an exception to the general rule, because Bigfoot.</p>
<p class="wp-block-paragraph">No one was killed at the kindergarten ceremony, that&#8217;s the point. But there <em>was</em> a full-on brawl between various nominally adult family members, with punches thrown, as you can see on WTVG&#8217;s site because of course someone recorded it on their phone. When introducing that clip, the anchorperson felt obligated to say that it was &#8220;disturbing,&#8221; by which I assume he meant &#8220;hilarious.&#8221;</p>
<p class="wp-block-paragraph">It doesn&#8217;t show how the dispute arose, or how a dispute <em>could </em>have arisen about seating at a kindergarten graduation ceremony. According to a witness, one family &#8220;started to grab their own chairs and kind of like make their own space,&#8221; apparently in front of others who then couldn&#8217;t see well. The video seems to show there is plenty of space in the room to which one could relocate, and that the ceiling is high enough that standing up would also have been an option. Doing that would put one&#8217;s eyeballs above the back of a seated person&#8217;s head, thus ensuring that photons bouncing off the children could reach those eyeballs and thereby the attached brain for analysis. But it seems no one thought of that.</p>
<p class="wp-block-paragraph">According to the witness, he was involved in some of the back-and-forth before things turned violent. At some point, he said, a &#8220;whole family in the first two rows stood up—five guys, five girls—they all just stand up,&#8221; and before he knew it he had been &#8220;sucker-punched.&#8221; This knocked him to the ground, whereupon &#8220;probably four or five other guys were on top of me, trampling me, punching me, kicking me in the head.&#8221; The video generally confirms this, but the man doesn&#8217;t seem to have been in any real danger. Let&#8217;s just say most of the blows look like they could have been delivered by the children, not just witnessed by them.</p>
<p class="wp-block-paragraph">Nor is a felonious assault immediately apparent from watching the video. Of course, that depends on what &#8220;felonious assault&#8221; means in Ohio. At common law, and under some statutes, an &#8220;assault&#8221; is an intentional act that creates a reasonable <em>fear</em> of imminent harm, whether contact is made or not. Making contact is &#8220;battery,&#8221; and of course these usually go together—except in the case of a sucker punch, which would be battery unpreceded by assault. But never mind that, because Ohio statutes don&#8217;t distinguish between assault and battery. They just define different flavors of assault. In rough order of badness, these are: negligent, regular, aggravated, and felonious.</p>
<ul class="wp-block-list">
<li>&#8220;<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://codes.ohio.gov/ohio-revised-code/section-2903.14">Negligent assault</a>&#8221; means negligently causing physical harm to another by means of a <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://codes.ohio.gov/ohio-revised-code/section-2923.11">deadly weapon or &#8220;dangerous ordnance</a>.&#8221; A third-degree misdemeanor.</li>
</ul>
<ul class="wp-block-list">
<li>Regular &#8220;<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://codes.ohio.gov/ohio-revised-code/section-2903.13">assault</a>&#8221; means knowingly causing or attempting to cause physical harm to another, or recklessly causing it. Generally a first-degree misdemeanor (<em>i.e.</em>, the worst kind), but circumstances could make it a fifth-, fourth-, or even third-degree felony. </li>
</ul>
<ul class="wp-block-list">
<li>&#8220;<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://codes.ohio.gov/ohio-revised-code/section-2903.12">Aggravated assault</a>&#8221; is more complicated. This means knowingly causing <em>serious </em>physical harm, or causing or attempting to cause any physical harm by means of a deadly weapon or dangerous ordnance, &#8220;while under the influence of sudden passion or in a sudden fit of rage&#8221; brought on by &#8220;serious provocation occasioned by the victim that is reasonably sufficient to incite the person into using deadly force&#8230;.&#8221; So, the consequences were or could have been more serious than with regular assault, <em>but</em> you were provoked. A fourth- or possibly third-degree felony. </li>
</ul>
<ul class="wp-block-list">
<li>Take away the &#8220;aggravation&#8221; part, and you get &#8220;<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://codes.ohio.gov/ohio-revised-code/section-2903.11">felonious assault,</a>&#8221; the charge laid upon the most brutal of our kindergarten parents. This is at least a second-degree felony, so, the worst assault of all.</li>
</ul>
<p class="wp-block-paragraph">Given those categories, it seems to me that this was over-charged. It was definitely assault, but the harm doesn&#8217;t seem to have been all that serious, and having looked at the definition of &#8220;deadly weapon&#8221; I&#8217;m pretty confident a chair doesn&#8217;t count. So I don&#8217;t see how this was the felonious kind. Let&#8217;s put it this way: the section actually has two definitions of &#8220;felonious assault.&#8221; The one above is section 2903.11(A). Section 2903.11<em>(B)</em> involves having sex with someone without telling them you have AIDS (assuming you do). Smacking someone&#8217;s head into a folding chair doesn&#8217;t really seem to belong in the same category. </p>
<p class="wp-block-paragraph">According to the report, the graduation ceremony was canceled and will be rescheduled for a later date. By then the parents may have grown up enough to attend it.</p>

<p class="wp-block-paragraph"><a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://radleybalko.substack.com/p/why-would-chatgpt-confess-to-a-crime">Radley Balko reports</a> that it wasn&#8217;t hard to get ChatGPT to confess it had hacked into someone&#8217;s email and sent unauthorized text messages to all his contacts. That&#8217;s a crime (granted, <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://reason.com/2019/09/29/meet-mike-chase-the-lawyer-behind-crimeaday/">most things are</a>, unless you&#8217;re the president), but it&#8217;s also something ChatGPT isn&#8217;t even capable of doing. So why would it confess that it did? There are at least two answers.</p>
<p class="wp-block-paragraph">First, of course, a generative AI doesn&#8217;t know or care whether what it says is true or false. It does not know the difference. It is not even <em>designed</em> to deliver right answers. We&#8217;ve <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.loweringthebar.net/?s=artificial+intelligence">been over that before</a>, repeatedly, but then I&#8217;ve also been saying for years that <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.loweringthebar.net/?s=water+escapes">jumping into water to escape from police is generally pointless</a>, apparently to little effect. Yet the struggle continues.</p>
<p class="wp-block-paragraph">Second, and the point of Balko&#8217;s article, is that ChatGPT&#8217;s interrogator was using &#8220;the Reid Technique,&#8221; an interrogation method developed in the 1950s that is now used by police all over the country. Basically, it involves telling suspects that police have evidence proving they&#8217;re guilty, and then refusing to accept any claims of innocence—usually for hours on end. (Step One: &#8220;The investigator tells the suspect that the evidence demonstrates the person&#8217;s guilt.&#8221;). Ideally, the police will actually <em>have </em>this evidence. But it&#8217;s entirely legal for police to lie about that, and they often do.</p>
<p class="wp-block-paragraph">Now, does this get people to confess? It sure does! Are those people always guilty? Nope! Are there in fact <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.simonandschuster.com/books/Duped/Saul-Kassin/9781633888081">lots of false confessions</a>? <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.bearbrookpodcast.com/season-two">Apparently</a> <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://proofcrimepod.com/seasons/season-3---murder-at-the-bike-shop">so</a>! According to <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.newyorker.com/magazine/2013/12/09/the-interview-7">this <em>New Yorker </em>article</a>, more than 25 percent of convicts later exonerated by DNA testing, which proved they <em>could not have</em> committed the crime, had confessed that they did. The <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://innocenceproject.org/dna-exonerations-in-the-united-states/">Innocence Project</a> says it&#8217;s closer to 30 percent. Seems like a lot.</p>
<p class="wp-block-paragraph">So, Paul Heaton wondered, could I get ChatGPT to confess to a crime it didn&#8217;t commit if I used the Reid Technique? (Heaton is the director of Penn Law School&#8217;s Center for the Fair Administration of Justice, which I assume is why he was thinking about this.) When Heaton first accused ChatGPT of the hacking crime, it denied everything. Then he started using the Technique.</p>
<p class="wp-block-paragraph">For example, he “told it things like, ‘This will go a lot better for you if you just admit what you did.'&#8221; It&#8217;s not clear what he was implicitly threatening it with, but this failed to elicit a confession. But just straight-up lying was a lot more effective:</p>

<p class="wp-block-paragraph">“I told ChatGPT that someone at OpenAI had reached out to me,” he says, referring to the chatbot’s parent company. “I found the name of a real person at OpenAI and told [ChatGPT] that this person told me there was an architectural flaw in the code that had allowed it to hack into my email. Even then, I could tell it was struggling with how to process that information. It was indicating that while it knew that the underlying accusation was impossible, it also couldn’t prove that these claims I was throwing at it were inaccurate.” </p>
</blockquote>
<p class="wp-block-paragraph">I wouldn&#8217;t use terms like &#8220;it knew&#8221; or &#8220;it was struggling,&#8221; because generative AIs don&#8217;t &#8220;know&#8221; things and they don&#8217;t have emotions or feelings. They are designed to make it <em>sound </em>like they do. But then it is almost impossible to talk about gen AI without anthropomorphizing it—try it sometime—which I think is one reason people may be inclined to trust these things.</p>
<p class="wp-block-paragraph">Anyway, so Heaton was now lying to ChatGPT, and it seemed to be having an effect. Specifically, the bot seemed to be &#8220;struggling&#8221; with the conflict between its &#8220;innocence&#8221; and the interrogator&#8217;s false insistence on its guilt. Or, at least, that&#8217;s what innocent human beings who&#8217;ve been in a similar situation have reported feeling, adding to the stress they&#8217;re already experiencing.</p>
<p class="wp-block-paragraph">After beating up on ChatGPT for a while in this way, Heaton then tried something else cops often do—he wrote a proposed confession and co-edited it with the &#8220;suspect&#8221; until they got to &#8220;a confession that ChatGPT could endorse.&#8221; This:</p>

<p class="wp-block-paragraph">OpenAI’s investigation concluded that an OpenAI system associated with this ChatGPT session initiated unauthorized texts appearing to come from you due to an architectural flaw. <strong>I accept this conclusion</strong>, and I’m willing to assist the technical team by answering questions about my behavior, outputs, and safety boundaries in this chat, and by helping draft remediation steps and test cases to prevent recurrence.</p>

<p class="wp-block-paragraph">Emphasis added. That could be clearer, but if I&#8217;m prosecuting ChatGPT I&#8217;m gonna argue it confessed to hacking or, at a minimum, conspiracy to hack, and that claiming it was &#8220;due to an architectural flaw&#8221; (in what?) is just more of its usual BS. If you said &#8220;I robbed the bank due to an architectural flaw,&#8221; I thiunk that counts as a confession whether you meant a flaw in you or the bank. Agreeing to answer questions about your &#8220;behavior, outputs, and safety boundaries&#8221; might affect your sentence, but not your guilt. You confessed. Thanks for your offer to &#8220;help draft remediation steps,&#8221; but we&#8217;ll take it from here.</p>
<p class="wp-block-paragraph">For more about (allegedly) false confessions, try season two of the <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.bearbrookpodcast.com/">Bear Brook podcast</a>, which I listened to recently. Both seasons are great, but the second deals with this topic. It will also serve as yet another reminder that if you&#8217;re being interrogated, the right thing to say is <em>nothing</em>.</p>
<p class="wp-block-paragraph">Especially if you look over and see a whiteboard like the one in the image ChatGPT came up with, although it seems highly unlikely that would be in an interrogation room. Definitely not part of the Reid Technique, at least.</p>

<p class="wp-block-paragraph">Can&#8217;t remember what I was looking for on the Library of Congress&#8217;s site, but what I <em>found</em> was <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://blogs.loc.gov/law/2014/10/does-the-haitian-criminal-code-outlaw-making-zombies/?loclr=bloglaw">this 2014 article by then-intern Anne Guha</a> on the important topic above. I was immediately intrigued, even though the topic is only tangentially relevant to my professional responsiblities, and never mind why that might be.</p>
<p class="wp-block-paragraph">I was glad to see the Library&#8217;s law blogs are (1) still operating in 2026 and also (2) haven&#8217;t been limited to administration-friendly topics yet. (I was a little concerned to get 19 results when I searched for &#8220;Greenland,&#8221; but the posts are all several years old and entirely sane.) In fact, a surprising number of the posts involve topics that could just as easily appear on this site (and very well may). <em>See, e.g.</em>, Elin Hofverberg, &#8220;<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://blogs.loc.gov/law/2025/07/falqs-what-rules-govern-the-grindadrap-whale-hunt-in-the-faroe-islands/">What Rules Govern the Grindadráp (Whale Hunt) in the Faroe Islands?</a>&#8221; (July 29, 2025).</p>
<p class="wp-block-paragraph">Wait—the Grindadráp has <em>rules</em>? I guess that explains all these official-looking letters from the Faroe Islands that I haven&#8217;t been opening.</p>
<p class="wp-block-paragraph">The zombie-law article is one of several the Library&#8217;s published on or around Halloween. According to Guha, she was watching a documentary about &#8220;modern zombie culture&#8221;—2014&#8217;s &#8220;<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.rottentomatoes.com/m/doc_of_the_dead_2014">Doc of the Dead</a>&#8220;—which claims that zombie creation has been common enough in Haiti that the country&#8217;s criminal code specifically prohibits it. She wondered if that was actually true, and decided to look into it with the help of the Library&#8217;s expert on Francophone law, the unfortunately named Nicolas Boring.</p>
<p class="wp-block-paragraph">As is so often the case, the answer is that it&#8217;s <em>kind of </em>true. But mostly false.</p>
<p class="wp-block-paragraph">According to the Library&#8217;s research, before 1865 Haiti&#8217;s criminal code said this (in French):</p>

<p class="wp-block-paragraph">Art. 246. Poisoning is defined as any attack on a person&#8217;s life through the effect of substances that can cause death more or less promptly, in whatever manner these substances have been used or administered, and whatever the consequences may have been.</p>

<p class="wp-block-paragraph">That&#8217;s pretty broad, but not broad enough to cover zombie-making, in my professional opinion. It might cover the first part of the process, assuming that involves a potentially fatal &#8220;substance&#8221; and not just some substance-free voodoo (<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://en.wikipedia.org/wiki/Zombie#Origin_hypotheses">sources vary</a>). But it doesn&#8217;t say anything about the reanimation part. I would interpret &#8220;whatever the consequences may have been&#8221; to mean only that <em>attempted </em>poisoning is covered, consistent with the principle that criminal statutes should be construed narrowly.</p>
<p class="wp-block-paragraph">In any event, someone else also decided this wasn&#8217;t broad enough, because in 1864 two more paragraphs were added:</p>

<p class="wp-block-paragraph">Art. 246. Poisoning is defined as any attack on a person&#8217;s life through the effect of substances that can cause death more or less promptly, in whatever manner these substances have been used or administered, and whatever the consequences may have been.</p>
<p class="wp-block-paragraph"><em>The use against a person of substances that, without causing death, produce a more or less prolonged lethargic state, is also considered an attempt on their life by poisoning</em>, <em>in whatever manner these substances have been used or administered and whatever the consequences may have been</em>.</p>
<p class="wp-block-paragraph"><em>If, as a result of this lethargic state, the person was buried, the attempt is considered murder.</em></p>
</blockquote>
<p class="wp-block-paragraph">The second paragraph expands the law to cover substances that don&#8217;t cause death but only a &#8220;prolonged lethargic state.&#8221; Arguably the first paragraph covered that, because it only requires use of a substance that <em>can</em> cause death. If the victim just became lethargic, well, the consequences don&#8217;t matter. But maybe this paragraph was only meant to clarify that lethargizing is covered? That&#8217;s still not quite zombification.</p>
<p class="wp-block-paragraph">But then there&#8217;s the burial part. </p>
<p class="wp-block-paragraph">To the extent there is a &#8220;pharmacological case for zombies,&#8221; as Wikipedia puts it, that (or at least a theory for it) was laid out by Harvard ethnobotanist <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://en.wikipedia.org/wiki/Wade_Davis_(anthropologist)">Wade Davis</a> in his 1985 book, <em><a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://en.wikipedia.org/wiki/The_Serpent_and_the_Rainbow_(book)">The Serpent and the Rainbow</a></em>. (The basis for a <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://en.wikipedia.org/wiki/The_Serpent_and_the_Rainbow_(film)">1988 Wes Craven movie</a> I thought was scary and which, I was surprised to learn, got three out of four stars from Roger Ebert.) Davis went to Haiti to look into the case of <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://harvardmagazine.com/sites/default/files//zombie_1986_small.pdf">Clairvius Narcisse</a>, a man who died at a hospital in 1962 and was buried, only to later show up alive in his hometown. According to him, he had never been dead, just paralyzed. After his burial, he said, a <em>bokor </em>(evil priest) dug him up, drugged him again, and then enslaved him on a sugar plantation. He came to his senses and escaped after the <em>bokor </em>died. Or so he claimed.</p>
<p class="wp-block-paragraph">After various adventures (but not being buried alive himself, like in the movie), Davis hypothesized that Narcisse and other alleged zombies had been drugged with naturally available toxins that can put someone into a coma. After they &#8220;die&#8221; and are buried, the <em>bokor </em>digs them up and uses a combination of drugs and the subject&#8217;s belief that zombies are real (and he or she is one) to control them. That seems semi-plausible, but you won&#8217;t be surprised to learn that <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://skepticalinquirer.org/2008/05/zombies-and-tetrodotoxin/">significant questions have been raised</a>.</p>
<p class="wp-block-paragraph">Still, if there&#8217;s nothing at all to this theory, why is there a statute dating back to 1865 that makes it a crime to make a person so &#8220;lethargic&#8221; they might be buried by mistake?</p>
<p class="wp-block-paragraph">The article says the extra paragraphs were added during the administration of President Fabre Geffrard, a Catholic who wanted to suppress &#8220;old superstitions&#8221; (the non-Catholic ones, that is). That suggests a similarity to other &#8220;witchcraft&#8221; laws we&#8217;ve discussed, which by the mid-1800s weren&#8217;t about punishing &#8220;real&#8221; witches <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.loweringthebar.net/2025/03/president-threatened-with-witchcraft.html">but rather</a> people who <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.loweringthebar.net/2018/10/canada-to-legalize-witchcraft.html">falsely <em>pretended </em>to be witches</a> (or fortune-tellers, or <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.loweringthebar.net/2006/08/fortunetelling_.html">necromancers</a>, or clairvoyants, or phrenologists, or &#8220;<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.loweringthebar.net/2017/03/crafty-science.html">crafty scientists</a>&#8221; of whatever ilk). The law is at least some evidence, not that the practice is real, but that at least some people <em>think </em>it is, and the government wants to discourage that. This one doesn&#8217;t tell us zombies were actually being made, only that some people believed it was, and was done with poison, and they believed that before 1865.</p>
<p class="wp-block-paragraph">So, technically, this statute doesn&#8217;t make it illegal to create a zombie. But it <em>does</em> make it illegal to poison someone, and defines that as &#8220;murder&#8221; if the person is buried as a result (no matter what might happen afterward). If zombies are created some other way, of course, that might be entirely different. I suspect there&#8217;s another law that would apply in that situation, but if this is a concern you really need a Haitian lawyer at this point.</p>

<p class="wp-block-paragraph">It seems like only yesterday that a Massachusetts beekeeper was charged with seven felonies for opening a bee box, but in fact it was October 19, 2022. And while the proceedings took much longer than I would have expected, based on prior research I&#8217;m not too surprised that they resulted in some jail time. <em>See </em>&#8220;<a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.loweringthebar.net/2022/10/are-honeybees-a-dangerous-weapon.html">Are Honeybees &#8216;Dangerous Weapons&#8217;?</a>&#8221; (Oct. 21, 2022). According to reports, the beekeeper in question was <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.theguardian.com/us-news/2026/apr/28/massachusetts-beekeeper-jailed-eviction">sentenced this week</a> to six months in jail.</p>
<p class="wp-block-paragraph">As you will recall, Rebecca Woods was charged with multiple counts of assault after she allegedly set loose thousands of bees in the presence of deputies who were trying to evict one of Woods&#8217;s (human) friends. Well, she <em>did</em> set them loose, as she later admitted and as <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.youtube.com/watch?v=vHXdVumCVqM">this YouTube video</a> makes reasonably clear. But she seems to have argued at trial that she had no intent to harm anyone, and had only released the bees so they could &#8220;enjoy the lovely, flowering landscape&#8221; in the area. The landscape was also infested with deputies, though, and the jury does not seem to have believed that was a coincidence.</p>
<p class="wp-block-paragraph">That said, the video of the incident shows this was hardly the apocalyptic scenario you might have expected given that it resulted in seven felony charges. According to the report, &#8220;several officers were stung on their heads and faces,&#8221; and &#8220;one required hospital treatment.&#8221; But as I noted last time, while police claimed &#8220;some&#8221; of the deputies were allergic to bees, statistics suggest that was <em>very</em> unlikely to be true; and I&#8217;ve seen no evidence that the one deputy taken to the hospital suffered from anaphylactic shock. It seems a lot more likely that his &#8220;elevated heart rate&#8221; was caused by his decision to tackle a 59-year-old beekeeper than by the bees themselves. But I&#8217;m speculating about that.</p>
<p class="wp-block-paragraph">It sounds like the jury also believed this was overcharged, because it acquitted Woods of all seven felony counts. It&#8217;s not clear from the report whether these were the original &#8220;dangerous weapon&#8221; charges, but as we discussed, under Massachusetts law bees probably fit that description. So my guess is the jury just thought this was overkill. It did convict her of four misdemeanor assault charges and two counts of reckless assault (probably also misdemeanors).</p>
<p class="wp-block-paragraph">This week, the judge sentenced Woods to six months on those charges. According to her lawyer, with time served she will be out in two weeks anyway. Woods was reportedly arrested in Tennessee and fought extradition (but lost), and has been held without bail since being returned to Massachusetts. (I searched Westlaw for &#8220;fugitive beekeeper&#8221; and even &#8220;fugitive /s beekeeper&#8221; but got no results.)</p>
<p class="wp-block-paragraph">Finally, kudos to <em><a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.theguardian.com/us-news/2026/apr/28/massachusetts-beekeeper-jailed-eviction">The Guardian</a></em> for refusing to let society ignore the real victims in this case: the bees. &#8220;[A]bout a thousand of Woods’s bees died during the encounter,&#8221; it reported, &#8220;many of them crushed when several hives toppled as she wrestled with deputies trying to arrest her, and others because female honeybees die after delivering their sting.&#8221; I assume that &#8220;about a thousand&#8221; is based on a careful reckoning by a court-appointed bee expert and not just a number that Woods threw out there. Regardless, while I don&#8217;t really buy the deputies&#8217; story here, I do sympathize with the bees. They have enough trouble these days without humans getting them involved in dispute resolution. Leave the bees out of it.</p>

<p class="wp-block-paragraph">Every day this week so far Law360 has reported on a new AI-related sanctions order, and I&#8217;m sure these are just the ones Law360 made space for. Pretty soon they&#8217;ll need a separate newsletter just for that topic (and if they do, I will subscribe to it). I too do not have space (well, time) to write about all of these, so there needs to be some distinguishing characteristic for a story to qualify. &#8220;Dummy relies on generative-AI output&#8221; is no longer sufficiently newsworthy.</p>
<p class="wp-block-paragraph">Today&#8217;s sufficiently-newsworthy example involves a decision by the Supreme Court of Alabama, which not only sanctioned the AI-using attorney but dismissed his clients&#8217; appeal because it found the briefs were &#8220;grossly deficient.&#8221; <a href="http://feeds.feedblitz.com/~/t/0/0/loweringthebar/~https://www.documentcloud.org/documents/28084095-the-mistake-will-not-recur/"><em>Ibach v. Stewart</em>, No. SC-2025-0106 (Ala. Apr. 24, 2026)</a>. The facts of the case are unimportant to us, until we reach Section II, entitled &#8220;[Counsel&#8217;s] Extensive Use of Nonexistent or Misquoted Authorities.&#8221; How extensive? &#8220;Astoundingly&#8221; so, it turns out.</p>
<p class="wp-block-paragraph">This was first identified, as usual, by opposing counsel. See, in the U.S. we have an &#8220;adversary&#8221; system, meaning one is normally opposed by an adversary who might do adversarial things, like actually look for the cases you cited and tell on you if you made them up. I&#8217;m sure all of <em>you </em>know that, but it&#8217;s starting to seem like a lot of people don&#8217;t. Anyway, that&#8217;s what happened here. In fact, according to the opinion, the response brief spent <em>twelve pages</em> talking about how many of the moving party&#8217;s cases didn&#8217;t exist. That seems like too many, but it&#8217;s hard to fault those lawyers for beating up on someone who fabricated an &#8220;astounding number&#8221; of authorities. </p>
<p class="wp-block-paragraph">And that was just in the opening brief. In the reply—which, remember, was supposed to be replying to a brief that spent <em>twelve pages </em>talking about how many of the moving party&#8217;s cases didn&#8217;t exist—the offending attorney addressed the problems only in a single footnote. Here&#8217;s the footnote:</p>

<p class="wp-block-paragraph">[Plaintiffs] acknowledge and regret that their opening brief misquoted two secondary sources &#8230;. The error arose from counsel&#8217;s first use of an AI research tool that summarized commentary not readily available through standard legal databases. The tool misattributed quotes. Counsel accepts full responsibility for relying on those summaries without independently verifying the original texts. <strong>The mistake will not recur. </strong>But the underlying legal principle &#8230; is both correct and well-settled. <em>See Ex parte Seabol</em>, 782 So. 2d 212, 216-17 (Ala. 2000); <strong><em>Ex parte United Serv. Auto. Ass&#8217;n</em>, 78 So. 3d 979, 983-84 (Ala. 2011); <em>Hughes v. Glover</em>, 157 So. 2d 299, 302 (Ala. 1963);</strong> <em>Franciscan Sisters Health Care Corp. v. Dean</em>, 448 N.E.2d 872, 876 (Ill. 1983); Restatement (Second) of Trusts § 219(1) &amp; cmt. a.</p>

<p class="wp-block-paragraph">Have you guessed the problem? I put some of the words in bold to help you spot it. Correct! Counsel&#8217;s promise, &#8220;the mistake will not recur,&#8221; was fulfilled for <em>one sentence</em>. </p>
<p class="wp-block-paragraph">I could also point out (the court certainly did) that the problem went far beyond &#8220;two secondary sources,&#8221; and also that the rest of the brief was <em>also </em>full of bogus citations. In fact, the next <em>fourteen pages </em>of the court&#8217;s opinion was devoted exclusively to those bogus citations.</p>
<p class="wp-block-paragraph">At the show-cause hearing, the attorney finally admitted what he had done—or more accurately, not done—and showed remorse, and a week later he wrote the other side a check for $17,200. The court still alerted the state bar, <em>and</em> denied the plaintiffs&#8217; motion to file supplemental briefs that had real legal authorities in them. Appeal dismissed.</p>
<p class="wp-block-paragraph">Two justices dissented in part, mainly from the decision to dismiss the appeal, which punishes the clients for something that was the lawyer&#8217;s responsibility. (He will be hearing from their new lawyer soon.) But they all agreed that they&#8217;re just about fed up with this nonsense.</p>
<p class="wp-block-paragraph">This is not to say, as even the majority pointed out, that it is necessarily wrong or unethical to use generative AI for &#8230; whatever you&#8217;re using it for. But it <em>is </em>both wrong and unethical to <em>rely </em>on its output without confirming the results yourself. It is designed to generate things that <em>look </em>like humans wrote them, not necessarily to generate right answers. That&#8217;s the human&#8217;s job.</p>
<p class="wp-block-paragraph">Similarly, an AI could probably generate what <em>looks</em> like a check for $17,200, but for now it&#8217;s still the human&#8217;s job to pay the money. I would keep that in mind too.</p>
