A federal judge allowed lawsuits to move ahead alleging that taking Tylenol while pregnant increases the risks of a child being diagnosed with autism or ADHD.
On Thursday, U.S. District Judge Denise Cote, in the Southern District of New York, denied Johnson & Johnson’s motion, which insisted that U.S. Food and Drug Administration regulations preempted claims that it failed to warn of Tylenol’s prenatal risks. Cote found Johnson & Johnson could add to Tylenol’s warning label, which advises women who are pregnant or breastfeeding to “ask a health professional before use.”
