The Arizona Supreme Court sided with a radio talk-show host and iHeartMedia in a defamation suit, finding his statements about Republican politician Daniel McCarthy weren’t actionable.

In an April 14 opinion, Justice William G. Montgomery reversed a lower court’s ruling after concluding that the statements from James T. Harris, made on his show “The Conservative Circus,” weren’t actionable as they couldn’t be reasonably interpreted as factual assertions, weren’t provable as false, and weren’t defamatory.
