The U.S. Court of Appeals for the Eighth Circuit rejected a South Dakota farmer’s request for a new trial after his efforts in helping to persuade other farmers join Watts Guerra’s mass tort litigation against Syngenta in state court matters, finding a jury award of $175,000 compensatory damages was neither inadequate nor an inappropriate compromise.

In a March 23 opinion, the appellate court affirmed by the U.S. District Court for the District of South Dakota also denying Watts Guerra’s renewed motion for judgment, as well as the motion filed by the farmer/plaintiff, Lowell Lundstrom, Jr., for a new trial.
