The Ohio Supreme Court has denied an affidavit to disqualify a probate court judge, chastising the plaintiff’s counsel for failing to file the affidavit until nearly three years after becoming aware of a potential conflict of interest.

Supreme Court Chief Justice Sharon L. Kennedy issued a 10-page order March 8, after a January decision to deny the affidavit, finding plaintiffs counsel, Andrew D. Schlichter of Schlichter Bogard & Denton in St. Louis, “did not act with the requisite speed and diligence.”
