A Massachusetts federal judge has agreed to dismiss Pfizer and the plaintiff’s former attorneys in the matter of a former Wyeth Pharmaceuticals employee who alleged his legal team committed fraud during the course of representing him in a wage-and-hour suit against his employer.

The plaintiff, Brett Arbogast, began working for Wyeth in March 2004. During that time, Arbogast complained that his position was misclassified as exempt under the Fair Labor Standards Act. By June of 2004, Wyeth terminated Arbogast. Since that time, Pfizer has become the successor company to Wyeth, according to the Feb. 9 opinion by U.S. District Judge Denise J. Casper of the District of Massachusetts.
