After a division of the Arizona Court of Appeals this week rejected a claim made by the state’s Republican Party that alleged mail-in voting laws violated the Secrecy Clause of the Arizona Constitution, the plaintiffs’ lead counsel voiced the likelihood of taking the matter to the state high court.
According to the opinion filed Tuesday, the appeals court upheld a ruling by the Mohave County Superior Court that found Arizona’s mail-in voting laws adequately preserve secrecy in voting, and denied efforts of the Arizona Republican Party (AZGOP) and its chairwoman, Kelli Ward, from seeking a preliminary injunction to prevent the Arizona Secretary of State and county election officials from carrying out mail-in voting for the 2022 general election.
