Attorneys for the family of a police officer who died following the Jan. 6 attack filed a civil suit against former president Donald Trump late Thursday, hours before the statute of limitations on their claims would have become untimely.

Admittedly a substantive procedural move, attorney for the plaintiff, Sandra Garza, Mark Zaid told the National Law Journal the suit mirrors suits filed by those injured two years ago Friday. Still, it’s unique as the first-of-its-kind wrongful death claim against the former president, but the claims also came with timing concerns; under D.C. law wrongful death claims are limited to a two-year statute of limitations.
