A federal appellate panel split Monday over whether Congress gave presidents the power to require that federal contractors be vaccinated, sparring over the so-called “major questions” doctrine.
The underlying appeal involved President Joe Biden’s September 2021 executive order directing the federal government to include a clause in contracts with businesses it works with to require that their employees are vaccinated against COVID-19.
