A federal judge denied Suffolk University’s motion to dismiss and rebuked the school for misinterpreting his previous order denying class certification to student plaintiffs who paid tuition and fees for the spring 2020 semester when the university transitioned to online learning due to COVID-19 during the semester.
U.S. District Judge William G. Young of the U.S. District of Massachusetts said the university “boldly interpreted” his Oct. 11 order to mean the plaintiffs could never reach class standing and said the counsel improperly moved to dismiss the students’ suit for lack of jurisdiction.
