In an issue of first impression, the U.S. District Court for the District of Maryland has certified an interlocutory appeal to the U.S. Court of Appeals for the Fourth Circuit regarding whether 501(c)(3) tax exempt status constitutes federal financial assistance under Title IX.

Five former students of Concordia Preparatory School, formerly known as Baltimore Lutheran High School, made accusations ranging from verbal harassment to rape, dating back to 2016, according to the opinion filed on July 21 in the U.S. District Court for the District of Maryland.
