A federal judge in Virginia has rejected a plaintiff’s claim that a jury should have awarded a significantly higher damages amount of $396,832.59 for a breach of fiduciary duty of loyalty, rather than the $59,000 actually awarded.
According to the Oct. 17 opinion, the plaintiff, GMS Industrial Supply, a seller of industrial products to military customers, sued a former employee and several other people and entities. GMS claimed that while employed by GMS, the defendants breached their fiduciary duty of loyalty by soliciting GMS sales agents and customers to sell for competing companies and by misappropriating trade secret information.
