BELIEF SYSTEM - It’s been just over a week since Judge James Ho of the U.S. Court of Appeals for the Fifth Circuit promised to stop hiring Yale Law School grads. But new comments from one of his fellow Fifth Circuit judges have renewed a debate in the clerkship world: does ideology matter for clerkships? “I regularly (and recently) have had Yale clerks who, consistently, are extremely talented and performed spectacularly in upholding the rule of law and supporting toleration for diverse viewpoints,” said Judge Jerry Smith, a 35-year veteran of the Fifth Circuit, who called Ho’s comments “regrettable.” Smith made the comment in the Administrative Office of the U.S. Courts’ Online System for Clerkship Application and Review, OSCAR, days after Ho said he’d refuse to support “the closed and intolerant environment that Yale embraces today.” Janet Siegel Brown, director of judicial clerkships at Northwestern University’s Pritzker School of Law, told Law.com’s Brad Kutner that different judges have different priorities when hiring. Likewise, Brown said, many students apply for clerkships simply want to have successful law careers with little regard for who they work for. “Some are specific, geographically or type of judge, maybe because of the types of cases the courts see,” she said, suggesting many applicants most often think of cities before judicial philosophy: “They just want the experience.”
ON THE RADAR - Pesticide manufacturers Syngenta Inc. and Corteva Agriscience were hit with an antitrust class action Friday in North Carolina Middle District Court. The suit, brought on behalf of direct purchasers, contends that the defendants unfairly impede competition through loyalty programs that incentivize distributors to to stop selling cheaper generic products. The lawsuit, which is backed by Lowey Dannenberg, Korein Tillery, Paynter Law Firm and Nussbaum Law Group, follows similar antitrust claims from the Federal Trade Commission and 10 state attorneys general.
