A federal judge has permanently blocked Indiana’s requirements that forced health care providers to bury or cremate fetal tissue from an abortion regardless of the patient’s religious or moral beliefs.
U.S. District Judge Richard L. Young of the Southern District of Indiana Monday, in part, sided with the the plaintiffs with respects to its free speech and free exercise claims against the state’s enforcement of fetal disposition and disclosure requirements. Indiana law prevents abortion providers from disposing of fetal tissue as medical waste.
