Cole Schotz partner Cameron A. Welch has entered an appearance for brand consulting firm Burns Group NYC in a pending trademark infringement lawsuit over Rite Aid’s $700 million rebranding. The action, filed March 28 in Pennsylvania Eastern District Court by Orrick, Herrington & Sutcliffe on behalf of design firm Brand Design Company Inc., contends that Rite Aid’s new logo uses a proprietary font owned by Brand Design. The suit asserts that Burns Group, which designed the Rite Aid logo, licensed the font but is expressly prohibited from using it in a logo. The case, assigned to U.S. District Judge Wendy Beetlestone, is 2:22-cv-01174, Brand Design Company, Inc. v. Rite Aid Corporation et al.
