In a blow to Bayer, U.S. Solicitor General Elizabeth Prelogar said in an amicus brief that the U.S. Supreme Court should deny review of its petition to reverse an $80 million Roundup verdict.

Tuesday’s filing comes two years after the Justice Department under President Donald Trump sided with Bayer’s preemption argument in the case, which was then before the U.S. Court of Appeals for the Ninth Circuit. Despite scientific findings that glyphosate is carcinogenic, the U.S. Environmental Protection Agency has approved Roundup’s key ingredient as safe.
