A federal appeals court rejected arguments from a man who claimed his rights to counsel and allocution were violated when a judge muted him during his remote sentencing.

In Monday’s opinion from the U.S. Court of Appeals for the Eighth Circuit, Missouri man Joshua Braman argued his ability to communicate with his attorney was infringed when U.S. District Judge Stephen Clark of the Eastern District of Missouri muted him twice during his sentencing hearing last year for a firearms possession charge that he pleaded guilty to.
