The U.S. Court of Appeals for the Sixth Circuit has affirmed a civil-contempt order imposed on two Michigan lawyers who engaged in repeated litigation misconduct and then twice missed deadlines for paying an attorney-fee sanction of more than $50,000.

In a firmly stated opinion knocking down the two attorneys’ appeal of the contempt order, which each lawyer grounded in their alleged inability to pay the sanction, a Sixth Circuit panel wrote, “At no point did either attorney provide any actual evidence of his financial status, let alone ‘categorically and in detail,’” citing Elec. Workers Pension Tr. Fund of Loc. Union #58, IBEW v. Gary’s Elec. Serv.
