A federal appeals court is poised to throw out a lawyer’s challenge to a district court decision in which the judge said he would make a referral to an attorney grievance committee over a 2020 election lawsuit.

Judges David Tatel, Ketanji Brown Jackson and Gregory Katsas of the U.S. Court of Appeals for the D.C. Circuit all sounded highly skeptical Thursday of the arguments that Erik Kaardal could appeal that lower court order. U.S. District Judge James Boasberg referred Kaardal to the grievance committee earlier this year.
