Earlier this month, the U.S. Court of Appeals for Seventh Circuit issued a 2-1 ruling in Whole Woman’s Health Alliance v. Rokita, allowing several of Indiana’s abortion restrictions to remain in effect while the state appeals the original lawsuit challenging those restrictions.

Whole Woman’s Health Alliance, which has a clinic in South Bend, Indiana, originally challenged 25 different parts of the state law on the grounds that they impose undue burden on a woman’s right to obtain an abortion. The appellate court permitted the following laws to remain in effect:

  • Chemical abortions may only be performed by physicians.
  • Second-trimester abortions must be performed in a hospital or surgical center.
  • Patients must receive in-person counseling prior to undergoing an abortion.
  • Patients must receive an in-person exam prior to undergoing an abortion.
  • Medical staff must provide abortion services in person rather than by telemedicine.
