The trustee of the Girardi Keese bankruptcy has filed a new lawsuit on behalf of the estate of the defunct Los Angeles law firm, this time alleging the firm’s former co-counsel in a case failed to turn over potentially millions of dollars in legal fees.

The adversary proceeding, filed Aug. 20, is the third brought by Elissa Miller, trustee in the Chapter 7 bankruptcy of Girardi Keese, whose founding partner Tom Girardi faces a potential criminal investigation and disbarment for allegedly pocketing tens of millions of dollars in client settlement funds. Miller contends former Girardi Keese partner Robert Finnerty and another attorney, Robert Mandell, of Mandell Trial Partners in Woodland Hills, California, owe legal fees to Girardi Keese for their representation of residents living near a toxic recycling plant operated by bankrupt Exide Technologies.
