A sexual harassment and sexual assault suit against Fox Rothschild is nearly out of gas, with the future of the case dependent on whether the plaintiff, a legal assistant in the firm’s Morristown, New Jersey, office, can show a New York nexus to her claims.

A federal judge has dismissed claims against Fox Rothschild and attorney Ian Siminoff based on New York City, New York state laws and New Jersey laws as well as claims for assault and battery, infliction of emotional distress and negligent supervision. The judge is allowing the plaintiff to file an amended complaint to address what was termed an “insufficient” connection to New York City and New York state for human rights laws in those jurisdictions to apply.
