With a fast-approaching presidential election in the background, the U.S. Supreme Court on Monday agreed to decide whether President Donald Trump’s “remain in Mexico” immigration policy and his use of defense funds to build a U.S.-Mexico border wall were legal.

The high court’s action marks the third time in as many days that the justices granted review in a challenge to a major and controversial Trump administration policy. The court on Friday said it would decide whether the president has the authority to exclude undocumented immigrants from the 2020 census report used to determine apportionment of U.S. House seats.
