Judge Amy Coney Barrett on Tuesday declined to commit to recusing herself from cases involving the Affordable Care Act or the 2020 election if they were to come before her as a U.S. Supreme Court justice, but also said she had not made any commitments to ruling a certain way in such legal fights.
During an exchange with Vermont Democratic Sen. Patrick Leahy, the former chair of the Senate Judiciary Committee, Leahy pointed to Trump’s prior remarks on the role of the Supreme Court in a potential dispute over the results of the Nov. 3 presidential election. Trump said at a debate earlier this month that he was “counting on” the court to resolve any issues with ballots in the vote, suggesting without evidence that Democrats are attempting to rig the race.
