In a ruling of June 23, 2020, which made international headlines this summer, the German Federal Court of Justice held that Facebook needs to comply with the decision of the German Federal Cartel Office (FCO) prohibiting Facebook’s data collection policy until the appeal is decided.

In February 2019, after a 3-year investigation, the FCO found that Facebook had committed an exploitative abuse of dominance pursuant to sec. 19(1) of the German Competition Act (GWB) by dictating unfair contractual terms that it could not have achieved in a competitive market.
