A divided panel on the U.S. Court of Appeals for the Fourth Circuit ruled Wednesday in favor of the Trump administration’s new “public charge” rule, conflicting with other recent circuit rulings.

In a 2-1 opinion, Judges J. Harvie Wilkinson and Paul Niemeyer found the administration’s new definition of “public charge”—migrants who receive 12 months of benefits over a three-year period—was admissible, therefore making it more difficult for those immigrants to obtain green cards in the U.S. The opinion did not touch on the merits of the rule itself.
