The Trump administration’s U.S. Justice Department has decided not to ask the U.S. Supreme Court to review an injunction blocking a policy that prohibited pregnant, undocumented minors from having access to previability abortions while in government custody.

The high court had twice granted the Justice Department an extension of time for filing any petition in Azar v. Garza until Nov. 8, but a department official confirmed that no petition was filed. The department’s decision not to seek review came as something of a surprise given its history of broadly opposing preliminary injunctions in other immigration cases.
