MORE, PLEASE - The Fifth Circuit in New Orleans today will hear a challenge to the Affordable Care Act, a case that pits the DOJ against the Democratic-led states and the U.S. House. As Angela Morris reports, President Trump’s DOJ reversed course in the middle of the case and stopped defending the signature healthcare initiative in the wake of a Texas judge declaring the whole law unlawful. California and other states, as well as the Democratic leadership of the U.S. House, want the Fifth Circuit panel to overturn the Texas judge’s decision.
RESIDENCY REQUIRED? - The U.S. Senate is set to take up President Trump’s nomination of Kirkland & Ellis litigation partner Daniel Bress for a seat on the U.S. Court of Appeals for the Ninth Circuit, a court the president has frequently criticized for ruling against his administration. Bress, whose nomination to the California-based seat has been opposed by the state’s two Democratic senators since he’s largely based in D.C., is poised to become the seventh judge appointed by Trump to take the Ninth Circuit bench. The court has one more current opening and two more seats set to come open as additional judges take senior status.
